the wire parked in asdas car park today a some complete ****** has killed the side door and scratched the little panel under the fuel filler ( the car was a vauxhall corsa ) asda security will not let us view the cctv footage , they say it is something to do with the data protection act , and like a fool the insurance company were told by the wife it happened in a private car park and will not cover it ! ask the police to ask asda to view the footage maybe they can do them for failure to report as well

If i were you matey id seek to find out if in fact the car park is private property ,now seeing as the road traffic act still stands whether on the highway or in a car park there is conflict in whether its classed as public or private,As it is an area open for use by the general public, then normal traffic laws apply so in fact that would mean the car park is in fact public area as it is subject to the same road traffic acts as if a public highway so id fight this all the way.

Crikey! I never knew this :? . Surely it's a public car park as the public has access to it? Sounds like a con by the insurance company Evil or Very Mad .

Under the the new road traffic act a road traffic collision covers a road or public place as Marc has stated and that includes places where you have to pay to park. Also there are numerous stated cases involving supermarket car parks in which judges have ruled that not only these places are public but are classified as roads! It would seem that these cases cover large supermarkets where there are several exits etc. Tell your insurer to get their facts right or report them to the ombudsman!

if its fully comp it shouldnt matter where it took place,recovery of your excess might be different but the insurance should cover you,my neighbors car went into his house wall and got paid,his drive is not apublic road

my excess on the car is £500
i have this weekend done a realy masterfull job of the bottom of the side door all those curves are an utter nightmare but it looks perfect even with a light , just got to get the paint mixed (hopefully the right shade Laughing ) Smile Smile
