If he's told you to bring it back so he can rectify faults then he should be given the chance, but mechanical items can be changed, rust and rot is a different matter and not easily rectified properly |

Thats right. Obviously I spoke to the guy made him aware of my problems and now he wishes to have it verifed for himself. So far can not fault him for that. However It is true that rust/rot, in this case are not going to be easily rectifiable. Possibly totally pointless to try and rectify, so I'm told. _________________ Make Tea Not War. |

Well to be fair when i spoke to him on the phone he followed the same routine as i have now read on pajero forum....
He says he has delt with delis for seven years on his add.....different cars have the same set of pics mixed up
AND he didn't seem to know about the brake lines through the wing issue.....which is odd for someone who has been dealing in delis for seven years...
I really hope you get your stuff sorted fella, i had what i thought was a terminal crack in the last one i had but it was fixed no problem...not always as bad as it looks. |

Fit for purpose is actually quite important in this case. Car dealers used to sell on utter trash that had been traded in, or just sell rubbish like this guy is, and would then try and get out of it by saying that the car was "sold as seen". Due to which they weren't responsible, trading standards however had other ideas, and motor traders must sell vehicles that are in reasonable condition, now what that exactly means I'm not sure, but I would argue that if you bought it from a dealer you would expect it to pass an MOT, or at least do so without much hassle or a few jobs, not to have the chassis rebuilt and major mechanicals.

I've just been looking at this guys ad`s on ebay and lo and behold he is selling a Delica for iirc £2,500.00 that i bought 18 mths ago accident damaged at the r/n/s although it wasn`t a write off i paid £600.00 for it at the time and beside the damage i did a few other jobs on it before selling it on although it was a resonably okay truck it most certainly isn`t worth anything like 2.5k .

Well my mechanic mate said if there was a roadside spot check the vehicle would be taken off me immeadiately. I feel very stupid right now but I'm going to overcome my ego and keep a document on here of all this. Like I said my mechanic friend spent only 10 minutes briefly looking the car over and in this time came up with seven things that would be an on the spot MOT fail.
He could t really be botherd looking any further in the the car. He was very polite and sympathised with me but it was obvious he knew Id been taken for a ride. Like I've said earlier I know noting about cars or mechanics (although I'd really like to learn now I've discovered Delics!)
The previous MOT certs, were from Suffolk and they were blatantly hooky. Hard to pin that on Dean though. MOT dated november last year and from no where near Wigan! But this Deli is certainly only good for breaking and should never have been sold as a usable (family) car. I guess thats what he meant by fit for purpose but more generally he meant not fit for legal road use. The advice he gave me was I should be trying to get my money back or a replacement vehicle that hs been inspected by a third party and shown to be in good working order.
I dropped it off tonight at Deans and via text he told me he would take it to his garage he uses on Monday and get back to me. I await to hear his verdict _________________ Make Tea Not War. |

Been in a similar situation in the past, remember its your tax and insurance ticking away....make him aware of this fact. The other issue is that it depends on how the works being paid for, going rate or a non paying job, if its a non paying job it'll keep getting pushed back . just keep the pressure on unless he has a courtesy car whilst he rectifies faults not down to you, you're the one without a vehicle you've already paid for. |

Don't forget that you have a legal right to ask for your money back, with additional payments to cover you for any financial losses incurred, such as insurance fees for changing to another vehicle. _________________

Without wanting to sound like an internet tough guy, having been burnt by someone selling me a heap of shite and trying to resolve it rather than just insisting on a refund - don't let him fix it.
Just get your cash and move on. Get your friend to put a written report together, and get notes from writing from anyone who saw the vehicle. Then get small claims, trading standards and your MP involved. Bill him for every single consequential loss - time off from work, travel costs, insurance, taxi fares, etc. Keep copies of all letters you send him - he will loose them.
Eventually you might get your money back. |

this guy has been shown many times to be an out and out liar , he will jerk you off hoping that you will just get fed up and disapear , i do hope you get sorted but i wouldn`t hold my breath on this one .

thanks for all the responses guys. v8rick - in all honesty I just about suspected what your saying there from the onset of realising I'd been sold a turkey because you started this thread. Still I think, (maybe misguidedly), that he said he wanted to get it looked at, so I gave him the benefit of the doubt to allow him to do this. This car isn't really fixable.(well it is just not worth doing financially, and it would be more than a day to do!) It took my guy less than 10 minutes to right it off so it wouldn't take another garage much longer to come to the same conclusion. I'm just trying to figure out what is the best way to go about resolving this. I imagine the legal route would take a good long time? _________________ Make Tea Not War. |

Depends.
Successful con men arn't stupid.
If it is clear to him that he will end up in court if he doesn't pay you and that he will loose, that you will be billing him for every single penny you can find an excuse to bill him for and that by the end of it he will be up to his eyeballs in trading standards and fraud investigations then he should refund before too long.
Small claims court is supposed to be fairly quick I think (Ie time units of months rather than years). And you may need to go that way if you want to see costs like insewerants and road tax again. |

Latest update. I spoke to Dean on Friday. His garage had still not seen my car as he said theyd been very busy, as they had three of his other cars in that week already. He said they'd look at it Tuesday or Wednesday after the bank holiday. He said that if the corrosion was as bad as I said it was then he'd be looking at giving me a full refund (I did not prompt this).
He said in all honesty he let that vehicle go out a bit too quickly and should have spent some time getting it looked at and sorted out before sale. He said He was a dealer and I'm a customer so he admitted he was at fault for all this. Again none of this was prompted by me. We discussed the MOT cert's for the vehicle and he said he'd be looking at getting some money back off the guy he bought it from and maybe the MOT station where it had its last MOT's. He said he'd be in touch with me Tuesday or Wednesday to sort out the money etc.
He seemed keener on saying he'd like to give me a refund than any other option, so fingers crossed! _________________ Make Tea Not War. |

Maybe he is maybe he isn't, if he's as bad as everyone claims he is it will matter little to him that he's being spoken about on some small quiet specialist corner of the internet! If he's not as bad as is reported on here then I hope for my sake he proves himself honourable.
